Program - Member Terms and Conditions
1.1 As an Infinite Rewards program member you will be bound by these Terms and Conditions, as varied by us from time to time, from the first time you use your membership card. Members will be advised of these variations within 48 hours of coming into force.
1.2 Terms and conditions set by participating businesses, where applicable, are available on request.
Meaning of words
2.1 In these Terms and Conditions the following words have the following meanings:
(a) "application form" means the form completed by an individual (whether online or in paper form) to become a member of the Infinite Rewards program;
(b) "Benefits" means discounts and special offers available from participating businesses as offered from time to time subject to any conditions as notified from time to time;
(c) "Infinite Rewards program" means those arrangements by which a member receives Benefits from participating businesses under these Terms and Conditions;
(d) "our website" means the Infinite Rewards website located at www.infiniterewards.com.au;
(e) "participating business" means retailers (and other persons) who supply goods and services in respect of which various discounts, special offers and other benefits may be claimed by members subject to any conditions determined by those retailers;
(f) "we" means Infinite Rewards Pty Ltd (ACN 112 086 790) trading as Infinite Rewards or its authorised representatives.
(g) "membership card" means a card or key tag issued to members of the Infinite Rewards program;
3.1 Only individuals (not corporations) may become members of the Infinite Rewards program.
3.2 To become a member of the Infinite Rewards online program you must either;
(a) Apply to us, in the manner notified by us from time to time, and pay the then current online membership fee; or,
(b) Be a customer, member or employee of one of our Corporate Clients (who may have funded your membership fee on your behalf).
You will become an Infinite Rewards online member once we accept your application and send you an acceptance email which will contain your login details.
3.3 We reserve the right to refuse any application for membership and refund any amount you have paid.
3.4 Membership is for a term of 12 months.
3.5 A renewal reminder email will be sent to you prior to your membership expiration. Your membership will not automatically renew at the end of the membership term.
3.6 For full memberships (not online), we will deliver the membership card to you within 2-3 working weeks from your welcome email.
Using your membership
4.1 You may use your membership to receive the Benefits.
4.2 All Benefits are subject to availability and any conditions as determined by the relevant participating business. It is your responsibility to satisfy or comply with any conditions imposed by participating businesses for the receipt of any Benefits.
4.3 Each participating business providing Benefits identifies you as being eligible for the Benefit in one or more of the following ways (at their discretion):
(a) when you quote your membership identification number (or username and password) if you are making a transaction by telephone, internet or mail order; or
(b) when you enter a specific promotional code; or
(c) when you click on a specific ‘click to save’ link.
Online and Full Program
(a) when you present your membership card at the point of sale at a retail outlet of the participating business; or
(b) when you quote your membership identification number (or username and password) if you are making a transaction by telephone, internet or mail order; or
(c) when you print a Benefit voucher from the our website and take it and your membership card to the retail outlet of the relevant participating business.
4.4 Benefits cannot be exchanged, transferred, sold, bartered, redeemed for cash or otherwise dealt with other than in accordance with these Terms and Conditions. If a Benefit voucher becomes lost or stolen it will not be replaced.
4.5 To the extent permitted by law we are not liable for any Benefit not being available for any reason whatsoever. In addition, and without limiting the foregoing, to the extent permitted by law we are not liable for:
(a) any delay by or failure of a participating business to notify us of the details of a Benefit;
(b) a failure by you to take advantage of a Benefit because you have not complied with the participating business's conditions (including limited time offers) for receiving the Benefit; or
(c) any failure by you to notify a participating business that you are a member and entitled to a Benefit.
4.6 Participating businesses may cease to be participants of the Infinite Rewards program from time to time. To the extent permitted by law we are not liable if you fail to receive a Benefit because a participating business ceases to be a participant in the Infinite Rewards program.
4.7 You must notify us immediately of any unauthorised transaction in relation to your membership.
4.8 You must notify us of any dispute relating to the Benefits as soon as possible after you become aware of the dispute. We will endeavour in good faith to resolve the dispute.
4.9 For full members (not online), membership cards are not credit or charge cards, are not transferable (except that you may permit members of your immediate family to use your card), and remain our property.
4.10 For full members (not online) You must notify us immediately of any change of address or of a lost or stolen membership card. To the extent permitted by law we are not liable for any delay in replacing a membership card or for any unauthorised use of a membership card. We may charge $10.00 per card for replacement cards.
Orders, Payment and Returns
5.1 All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.
5.2 Expiration of gift cards and vouchers may vary depending on the requirements of the participating business. Generally gift cards and vouchers have a minimum of 3 months expiry, unless otherwise specified on the Infinite Rewards website.
5.3 Infinite Rewards offers products for sale that are in stock and available for dispatch from our distribution centre. Occasionally however, we may be waiting for shipments from our suppliers. You will be notified of any delays due to low stock levels.
5.4 Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is an acceptance of your order.
5.5 We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item or that the item ordered is out of stock.
5.6 Payment can be made by Visa, MasterCard and American Express. Payment will be debited and cleared from your account upon dispatch of your order by Infinite Rewards. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Infinite Rewards, we will not be liable for any delay or non-delivery.
5.7 We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using Camtech, a secure online payment gateway that encrypts your card details in a secure host environment. If you are a registered Infinite Rewards user, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.
5.8 To help ensure that your shopping experience is safe, simple, and secure, Infinite Rewards uses Secure Socket Layer (SSL) technology. Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.
5.9 Please note that we aim to dispatch all orders within 72 hours. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Infinite Rewards is not responsible for any delays caused by destination or handling delays.
5.10 All cinema vouchers sold by Infinite Rewards are restricted by the terms and conditions of each individual voucher type which can be found in the Terms & Conditions of the individual offers. All cinema vouchers are non refundable and change will not be given irrespective of cinema pricing. Vouchers are valid until the expiry date indicated and cannot be exchanged or replaced. Ticket prices are subject to cinema pricing and may change without notice. Vouchers are sold for the personal use of Infinite Rewards members only. Vouchers are not to be re-sold and cannot be distributed.
5.11 At the discretion of Infinite Rewards and/or relevant to applicable consumer law, unused, cancelled items purchased through the Infinite Rewards online store may be returned within 7 days of purchase, at the cost of the member, to Level 13, 10 Queens Road Melbourne, VIC, 3004. At this point a customer may be entitled to a refund or exchange which will be initiated within 30 days of the receipt of the return item.
Termination of membership
6.1 To the extent permitted by law we will not be obliged to refund any part of a paid membership fee on cancellation of a membership, by you or by us, in accordance with this clause 6.
6.2 We may terminate your membership if you, or a member of your immediate family who uses a membership card:
(a) fail to comply with these Terms and Conditions;
(b) abuse any privilege accorded to you as a member under the Infinite Rewards program; or
(c) supply any false or misleading information or make any false or misleading misrepresentations to us or to any participating business in connection with the Infinite Rewards program or a Benefit.
6.3 You may terminate your membership prior to the expiry of the 12 month term by giving written notice to us. On receiving such notice, we will note your member contact details on our database as inactive.
Changes, suspension or termination
7.1 From time to time, we may need to change these Terms and Conditions. If we reasonably believe that any amendment to these Terms and Conditions will benefit you or have a neutral impact on you, we can make the amendment(s) immediately.
7.2 If we reasonably believe that an amendment to these Terms and Conditions will have a minor impact on you, we will provide you 21 days written or by placing a notice on the Site.
7.3 If we reasonably believe that an amendment to these Terms and Conditions will result in more than a minor impact on you, we will provide you 21 days written notice and we will allow you to cancel your membership. If you elect to cancel your membership under this clause 7.3, we will refund the membership fee, if any, paid by you to us, on a pro rata basis for the period of membership remaining after the cancellation of your membership.
7.5 To the extent permitted by law, we reserve the right to make any changes at any time without prior notice and in our absolute discretion to the Benefits.
7.6 Subject to applicable law, we reserve the right to suspend or terminate the Infinite Rewards program at any time without prior notice. To the extent permitted by law and subject to clause 7.5 below, we will not be liable for the suspension or termination of the Infinite Rewards program on any account whatsoever including (without limitation) for any Benefit that a member could have received at the time of suspension or termination.
7.7 If we terminate the Infinite Rewards program we will refund the membership fee, if any, paid by you to us, on a pro rata basis for the period of membership remaining after the termination of the Infinite Rewards program.
8.1 Information about members, including information in the application form and information about receipt of Benefits by members, will be held in our internal database ("our Database") which will contain information about you and your use of the membership.
8.2 We and our agents will only use the information from our Database to manage and administer the Infinite Rewards program.
8.3 Each member consents and agrees to the provision of the information on the application form to Infinite Rewards and authorises us to store and use that information, for the purposes stated in this clause 8.
9.1 Subject to clause 9.4, all conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Infinite Rewards program are expressly excluded to the full extent permitted by law. Any liability we may have to a member under statute in respect of such goods and services which cannot be excluded is limited, where permitted, to:
(a) supplying, or paying the cost of supplying, the goods or services again; or
(b) repairing, or paying the cost of repairing, the goods; at our option.
9.2 Subject to clauses 9.1 and 9.4, and to the extent permitted by law, any liability that we may have to a member whether for negligence, breach of contract or otherwise is limited:
(a) in the case of any claim relating to Benefits, to supplying, or paying the cost of supplying, the Benefit again or repairing, or paying the costs of repairing, the Benefit, at our option;
(b) in any other case to a maximum of $50.
9.3 Participating businesses do not have any authority, express or implied, to make any representation, warranty or statement on our behalf and we accept no liability in respect of such representations, warranties or statements.
9.4 Our services come with unconditional statutory warranties that they will be rendered with due care and skill and be reasonably fit for their purpose. You are entitled, at your option, to a refund, repair or replacement for a breach, and to compensation for any other loss. Any words in these words and conditions referring to "the extent permitted by law" and "subject to applicable law" are subject to these warranties.
10.1 A notice will be deemed to be given by us to a member if it is sent to the postal or email address of the member appearing in our Database as notified by you on the application form.
10.2 Any tax, liability or duty arising from a member's participation in the Infinite Rewards program is the responsibility of the member.
11.1 We may include hyperlinks on the Site to other websites or resources operated by parties other than Infinite Rewards, including advertisers and merchant partners. We have not reviewed all of the sites linked to the Site and is not responsible for the content or accuracy of any off-site pages, nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.
